Terms & Conditions

The terms on which you may use the Legacy app, websites and Care Pages, operated by Stewards Of Tomorrow Ltd.

General information

Legacy is operated by Stewards Of Tomorrow Ltd, a company limited by guarantee registered in England and Wales (company number 15589404). Registered office: C/O West & Berry Limited, Nile House, Nile Street, Brighton, BN1 1HW, United Kingdom. By downloading and using our app, visiting our websites, or giving through or creating a Care Page (together, the “Services”), you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, then you are prohibited from using the Services and you must discontinue use immediately. We recommend that you print a copy of these Terms and Conditions for future reference.

Legacy provides a giving platform, made available through the Services, that displays information about registered charities and non-profit organisations (“Cause” or “Causes”) and enables individual users to support the Causes of their choice.

Through Share To Care, people (“creators”) can also build a public Care Page showing the Causes they support and why, and share it so that others (“supporters”) can give to those Causes. The extra terms that apply to creators are in our Share To Care terms.

The Services and all related content (“Our Content”) is the property of Legacy including but not limited to giving portfolios (selected bundles of causes or charities) and news portal. Content that users add, such as a creator’s Care Page, is covered by The content you provide to us.

When you donate, you pay us and we make a matching payment to Charities Trust for the Causes you choose, as explained under How your donation reaches the Causes. Once made, a donation cannot be cancelled or refunded except as described under Refunds and disputes.

If you create a Care Page, our Share To Care terms form part of these Terms and Conditions. Our Privacy Policy and other pages on our Services, such as our FAQs, explain how Legacy works but are not part of these Terms and Conditions.

We may change these Terms and Conditions to reflect changes to our products, our users’ needs and/or our business priorities. Variation explains how we will tell you about a change and what you can do if you do not agree with it.

Our Privacy Policy explains how we use any personal data we collect from you, or that you provide to us. You must make sure the information you give us is accurate.

Your status

You may only use the Legacy Services if:

  • you are an individual aged 18 or over; and
  • you have the capacity to enter into legally binding contracts under the law applicable in your country of residence.

To create a Care Page you must also live in the UK, as set out in the Share To Care terms.

Under no circumstances are third parties allowed to download or use the Services on your behalf.

Acceptable use

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us. Creating a Care Page and sharing it under the Share To Care terms is an approved use, including on channels you use for your work.

As a user of the Services, you agree not to:

  • Systematically retrieve data or other content from the Services to compile a database or directory without written permission from us.

  • Use the Services to launder money, hide where money came from, or evade financial sanctions.
  • Use a payment card or bank account you are not authorised to use, including to test whether card details work, or use someone else’s Legacy account.
  • Evade, or try to evade, our identity, fraud or payment checks.
  • Make improper use of our support services, or submit false reports of abuse or misconduct.
  • Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
  • Interfere with, disrupt, or create an undue burden on the Services or the networks and services connected to the Services.
  • Attempt to impersonate another user or person, or use the username of another user.
  • Sell or otherwise transfer your profile.

Information you provide to us

You represent and warrant that: (a) all registration information you submit will be true, accurate, current, and complete and relate to you and not a third party; (b) you will maintain the accuracy of such information and promptly update such information as necessary; (c) you will be responsible for all use of your account; (d) you have the legal capacity, and you agree to comply with these Terms and Conditions; and (e) you are 18 or over.

If you know or suspect that anyone other than you knows your user information (such as an identification code or username) you must promptly notify us at support@givewithlegacy.com.

If you provide any information that is untrue, inaccurate, not current or incomplete, we may suspend or terminate your account and/or profile. We may remove or change a username you select if we determine that such username is inappropriate.

The content you provide to us

There may be opportunities for you to post content to the Services, such as a Care Page or the name you choose to show when you give through one, or to send feedback to us (“User Content”). You understand and agree that your User Content may be viewed by other users on the Services, and that they may be able to see who has posted that User Content.

You keep ownership of your User Content. You give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, adapt, display and share it so that we can run, improve and promote the Services. The licence ends when you delete the User Content or your account, except where we need to keep a copy by law or to deal with a complaint or dispute. If you create a Care Page, the Share To Care terms explain how we use your page. If you send us feedback or ideas, we can use them without paying you.

You warrant that any User Content you produce will comply with Acceptable use and Keeping Legacy safe, and you will be responsible for any loss or damage we suffer as a direct result of your breach of this warranty.

We have the right to remove any User Content you put on the Services if, in our reasonable opinion, it does not comply with those sections.

User Content is the responsibility of the person who posted it. We check some User Content, as described in Keeping Legacy safe, but our checks do not mean we have verified or approved it, and the views expressed by other users, including creators, do not represent our views or values. To the extent the law allows, we are not responsible for User Content posted by others, including any that contains incorrect information or is defamatory.

To report User Content, follow the steps in Keeping Legacy safe.

Keeping Legacy safe

Some parts of Legacy show content that people add, such as Care Pages and the names supporters choose to show on them. These rules apply to all of it, and we apply them consistently, whoever posted the content.

What is not allowed

You must not post or share content that:

  • is illegal, or encourages or helps anyone to break the law, including fraud, scams and impersonation;
  • is hateful, harassing, threatening, bullying or abusive, or encourages violence;
  • sexually exploits or endangers children, or is pornographic or sexually explicit;
  • promotes terrorism, self-harm or suicide;
  • shares someone’s private information or intimate images without their consent;
  • infringes anyone’s intellectual property or other rights; or
  • is spam, or misleads people about who you are or where their money goes.

How we check content

  • A person at Legacy reviews every Care Page before it goes public, and again whenever its name, photo, bio, causes or reasons change.
  • An automatic filter checks the names supporters choose to show on Care Pages. If it refuses a name, the gift shows as coming from “Someone”.
  • We act on reports from anyone, whether or not they have a Legacy account.

If we find content that is illegal or breaks these rules, we will remove it or make it unavailable as quickly as we can. We may also take a Care Page offline, suspend or close accounts, and report content to the police or other authorities where the law requires it or we believe it is right to.

Reporting content

If you see something on Legacy that you think is illegal or breaks these rules, email support@givewithlegacy.com with a link to it and why you are concerned. We will review it promptly and tell you what we have done.

Complaints and appeals

You can complain to us if:

  • you reported content and are not happy with how we dealt with it;
  • we removed your content, took your Care Page offline or restricted your account, and you think we got it wrong; or
  • you think we are not meeting our duties under the Online Safety Act 2023.

Email support@givewithlegacy.com with “Complaint” in the subject line. We will acknowledge your complaint within 5 working days and tell you the outcome within 20 working days or, if we need longer, explain why and when to expect it. Where we can, someone who was not involved in the original decision will look at it. If we got it wrong, we will put it right, for example by restoring your content.

Our content

Except as expressly provided in these Terms and Conditions, no part of the Services may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Services, you are granted a limited licence to access and use the content and to download or print a copy of any portion of the content to which you have properly gained access solely for your personal, non-commercial use.

You shall not (a) try to gain unauthorised access to the Services or any networks, servers or computer systems connected to the Services; and/or (b) make for any purpose including error correction, any modifications, adaptations, additions or enhancements to the Services or our content, including the modification of the paper or digital copies you may have downloaded.

We shall (a) prepare the Services and our content with reasonable skill and care; and (b) use industry standard virus detection software to try to block the uploading of content to the site that contains viruses.

The content on the Services is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from taking, any action on the basis of the content on the Services.

Although we make reasonable efforts to update the information on our Services, we make no representations, warranties or guarantees, whether expressed or implied, that content on the Services is accurate, complete or up to date.

The Services may contain links to websites or applications operated by third parties. We do not have any influence or control over any such third-party websites or applications or the third-party operator. We are not responsible for and do not endorse any third-party websites or applications or their availability or content.

How your donation reaches the Causes

When you donate, you pay Stewards Of Tomorrow Ltd. Stripe, which is authorised by the Financial Conduct Authority, processes the payment. We never see or store your full card or bank details.

Your donation is an instruction to us to make a matching payment to Charities Trust (registered charity 327489), our distribution partner, for the Causes you choose. The matching payment is your donation less the costs and any tip described under Fee schedule. We make it in our own name, usually by the day after your payment goes through, and we are responsible for making it.

Until we make the matching payment, the money stays in our Stripe account. Charities Trust and the Causes are not party to your payment to us and have no claim on that money. We do not have to make the matching payment from the same money, and we may combine donations into one payment.

Once we have paid Charities Trust, your donation becomes a gift to it, and your choice of Causes is a request to Charities Trust to pay them. Charities Trust decides how and when donations are paid out, and normally follows your choice. It checks each Cause before paying it, and may hold a payment until its checks are complete.

If Charities Trust cannot pay a Cause you chose, for example because the Cause has closed, cannot be verified or cannot legally receive the money, we will ask Charities Trust to choose another Cause with similar charitable purposes to receive your donation. Charities Trust makes the final decision, and we will tell you if this happens.

We may change our distribution partner by giving you at least 30 days’ email notice, which will tell you if you need to do anything. Donations we have already paid to Charities Trust remain with it, and it will pay them out. Gift Aid declarations are made to Charities Trust, so if you give monthly with Gift Aid, we will ask you to make a new declaration for the new partner.

Gift Aid

For Gift Aid, we act as your intermediary: we collect your Gift Aid declaration and send it to Charities Trust with our matching payment. Charities Trust claims Gift Aid on eligible donations.

When you donate through the Services, we may ask if you want to add Gift Aid by accepting a Gift Aid declaration. The declaration covers that donation and any future donations you make through Legacy until you cancel it. If you accept it, you consent to us sending Charities Trust your name and home address, which it will only use to claim Gift Aid, subject to the requirements of data protection laws.

By accepting the Gift Aid declaration, you are confirming that you are a UK taxpayer and understand that if you pay less Income Tax and/or Capital Gains Tax than the amount of Gift Aid claimed on all your donations in a tax year, it is your responsibility to pay any difference to HMRC. Please read the Gift Aid declaration in full before you accept it.

You can cancel your Gift Aid declaration at any time in the app or by emailing support@givewithlegacy.com. If your circumstances change, for example you no longer pay enough tax, or you change your name or home address, you must update your details in the app or let us know at the same address, so that Gift Aid is no longer claimed on your donations or is claimed against your correct details.

Causes

Causes receive your donation after the costs and any tip described under Fee schedule are deducted, together with any Gift Aid claimed on it.

You can find out more information about any cause listed on the Services by visiting the cause’s website or if they are a registered charity the Charity Commission for England & Wales. We are not responsible for the content of any third-party websites.

In certain situations, a Cause listed on the Services may be removed. You can only use the Services to make a donation if the Cause is listed in the Services. If a Cause you chose cannot be paid, How your donation reaches the Causes explains what happens to your donation.

Legacy may terminate agreements based on any reports of payment irregularity, fraud or misrepresentation set up by you on behalf of a charity. Causes displayed on the Legacy platform are not an indication of our endorsement or approval of such causes as the platform is open to the public and Causes can register as long as they are not in breach of our rules.

We do not share your details with Causes. If you choose in the app to let the charities you support contact you, Charities Trust may pass your contact details to those Causes so they can get in touch by the channels you picked. You can change these choices in the app at any time.

Legacy cannot guarantee that your donation will be used for the purpose you select and is not responsible for the actions of any Cause. Causes may use your donation for administration costs or for appeals not originally intended. Once a donation has been made, any dispute or dealings shall be between the donor and recipient Cause. If you require your donation to be for a specific purpose only, or you are dissatisfied about how funds are being used, you should contact the Cause directly.

Fee schedule

Legacy does not charge a platform fee. The third-party costs of processing and distributing your donation, and any optional tip you choose to give Legacy, are deducted from your donation before we make the matching payment to Charities Trust. Charities Trust also deducts a fee from any Gift Aid it claims. These amounts are shown before you confirm a donation, documented on the Legacy website and inside the application, and stated on your receipts.

Tips are optional and never pre-selected. You choose whether to add one, from 1% to 5% of your donation, or no tip at all, before you confirm. You can change the tip on a monthly donation in the app.

Giving through a Care Page

A Care Page is a public page where a creator shows the Causes they back and why. When you give through one:

  • We make a matching payment to Charities Trust for the Causes on the page, split the way you choose. These Terms and Conditions apply to your donation as they do to any other, including Fee schedule and Refunds and disputes.
  • The creator receives nothing from your gift. Legacy keeps nothing from it either, apart from any optional tip you choose to add.
  • You can give without signing in. If you do, we set up a Legacy account on the name and email address you give us, so that you can find your donation, receipts and Gift Aid later. You do not have to use it.
  • At the moment, gifts through a Care Page are one-off card payments. Stripe takes the payment, and it shows on your statement as STEWARDS* followed by part of the page address.
  • Your gift goes to each Cause’s general funds. The creator’s words explain why they back a Cause. They are not a promise, by the creator, the Cause or us, about how your gift will be spent.
  • Your name only appears on the Care Page if you switch on “Show my name”. It then shows as your first name and surname initial, to visitors and to the creator. The creator can hide it, and if you change your mind, email support@givewithlegacy.com and we will remove it.
  • Whether or not you show your name, the creator can see the amount, Cause and time of your gift, and the page may list it as a gift from “Someone” with its amount.

The creator is not our employee or agent, and does not speak for us or for the Causes on their page. If you are worried about a Care Page, tell us as described in Keeping Legacy safe.

Checks on donations

We and our partners check donations to prevent fraud and money laundering and to comply with sanctions law.

We may ask you to confirm your identity or where the money for a donation came from, for example if a donation is large or unusual. You must give us the information and documents we reasonably ask for. We may share them with Charities Trust, and with the authorities where the law requires it.

While we carry out these checks, we may hold a donation or delay our matching payment to Charities Trust. We may refuse or refund a donation, or suspend or close your account, if:

  • you do not give us the information we ask for, or we cannot verify it;
  • we reasonably believe a donation is linked to fraud, money laundering or other crime; or
  • accepting the donation or making our matching payment would break sanctions law or another legal restriction.

Where the law allows, we will tell you what we have done and why.

Refunds and disputes

We only refund donations in the cases below, or as described under Checks on donations. To ask for a refund, email support@givewithlegacy.com as soon as you can, with the date and amount of the payment.

We will refund a donation if:

  • it was made without your permission or fraudulently;
  • you were charged twice, or the wrong amount, because of a technical or payment error; or
  • the law or a regulator requires us to.

We may also refund a donation in other exceptional cases, such as an obvious typing mistake that you tell us about straight away.

After we make the matching payment to Charities Trust, usually by the day after your payment, we can no longer refund a donation unless we caused the error or the law requires it. In those cases, we will refund you from our own funds.

If you change your mind about a tip, email us within 30 days of the payment and we will refund it.

We make refunds to the card or bank account you paid with.

If you give by Direct Debit, you are also protected by the Direct Debit Guarantee, which entitles you to a full and immediate refund from your bank or building society if an error is made in the payment of your Direct Debit.

If you think someone has used your card or bank account without permission, contact your card provider or bank straight away, and let us know too.

Our liability

Unless prohibited by law, our liability for losses you suffer as a result of us breaking these Terms and Conditions is strictly limited to the amount you paid, including any costs and tip.

If you create a Care Page, the Share To Care terms set out our liability to you as a creator.

Nothing in these Terms and Conditions limits in any way our liability:

  • for death or personal injury caused by our negligence;
  • for fraud or fraudulent misrepresentation;
  • for any deliberate breaches of these Terms and Conditions by us that would entitle you to terminate the contract between us; or
  • for any matter for which it would be illegal for us to exclude or limit, or attempt to exclude or limit, our liability.

Subject to the list above, all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from these Terms and Conditions. This does not affect your statutory rights.

Subject to the list above, we are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us, including but not limited to:

  • loss of income or revenue;
  • loss of business;
  • loss of profits or contracts;
  • loss of anticipated savings; or
  • loss of or corruption to data;

howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. This does not prevent claims for direct financial loss that does not fall within the categories listed above.

Written communications

Applicable laws require that some of the information or communications we send to you should be in writing. By using the Services, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on the Services. For contractual purposes, you agree to this electronic means of communication, and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Notices

All notices given by you to us must be given to Stewards Of Tomorrow Ltd, C/O West & Berry Limited, Nile House, Nile Street, Brighton, BN1 1HW, United Kingdom (company registration number 15589404). We may give notice to you at either the email or postal address you provide to us when making a donation. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an email is sent, or three (3) days after the date of posting of any letter.

In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email, that such email was sent to the specified email address of the address.

Variation

We reserve the right to change these Terms and Conditions by providing you with at least two weeks’ notice by email, and will ensure that the most recent version is available on the Services.

If you do not want to continue to abide by these Terms and Conditions because of a change we are making, you have the right to terminate these Terms and Conditions immediately and without charge by giving us written notice before the change comes into effect. If you do not cancel during this period, then you will be deemed to have accepted them by using the Services and the changes will apply.

Termination

We may end these Terms and Conditions at any time if:

  • we discover that any of the information that you provided to us was incorrect; or
  • you have breached these Terms and Conditions (or we have reason to believe that you have, or intend to).

Otherwise, we will give you at least thirty (30) days’ notice of termination.

Notwithstanding termination of these Terms and Conditions, your liability to us will continue, and you will remain liable until all sums due under these Terms and Conditions have been paid by you in full.

You may terminate these Terms and Conditions at any time by emailing us at support@givewithlegacy.com. You will not be charged for termination. Donations you have already made cannot be withdrawn, except as described under Refunds and disputes. When these Terms and Conditions end, so do the Share To Care terms, and we will take any Care Page you have offline.

Your data

You may provide us with personal data from time to time in connection with your Legacy account. Some personal data will be necessary for us to provide you with the Services under these Terms and Conditions. You must notify us immediately of any change of name or email address by emailing us at support@givewithlegacy.com.

We will disclose your personal information to:

  • Charities Trust (registered charity 327489), which receives our matching payments for the Causes you choose. We send it your email address with each donation, and your name and home address when you have accepted a Gift Aid declaration, so that it can process your donations and claim Gift Aid. It will only use this information for those purposes, subject to the requirements of data protection laws. See Gift Aid for more.
  • The creator of a Care Page you give through, who sees the amount, Cause and time of your gift, and your name if you choose to show it. See Giving through a Care Page.
  • Our technology partners so that they can authorise and manage donations against your account.

Our payment provider, Stripe, runs security and fraud checks on payments, which may include checking the card or account you pay with.

We may use your personal data to:

  • provide you with services under these Terms and Conditions;
  • enable us to review, develop and improve our products and services;
  • help identify products and services that may be of interest to you;
  • undertake research and analysis; and
  • send you news and updates by email, if you have asked for them. You can unsubscribe at any time.

We may also disclose your personal data as required by law, regulation or any other competent authority or agency including to authorities and agencies to investigate possible unauthorised or unlawful activity.

You are entitled to see the information held about you, and you may ask us to make any necessary changes to ensure that it is accurate and kept up to date. If you wish to do this, please contact us at support@givewithlegacy.com. In normal circumstances, there will be no fee, however, we reserve the right to charge a reasonable fee to cover our administration costs if the request is deemed to be excessive or manifestly unfounded or if you request further copies of your data.

It is your responsibility to keep us updated of changes to your personal details. Failure to do so may result in us being unable to contact you regarding our Services, including the provision of refunds to which you might be entitled or to let you know about changes to these Terms and Conditions.

Further and more detailed information as to how we process your information can be found in our Privacy Policy.

No waiver

No delay or failure to exercise any right or remedy under these Terms and Conditions by either you or us shall be construed as a waiver of that right or remedy or preclude its exercise at any subsequent time.

Third-party rights

No one other than a party to these Terms and Conditions (and in the case of Legacy, their successors and permitted assignees) shall have any right to enforce any of its terms.

Severability

If any provision of these Terms and Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid, unlawful or unenforceable, such invalidity, unlawfulness or unenforceability shall not affect the other provisions of these Terms and Conditions which shall remain in full force and effect.

If any provision of these Terms and Conditions is so found to be invalid or unenforceable but would be valid or enforceable if some part of the provision were deleted, the provision in question shall apply with such modification(s) as may be necessary to make it valid.

Assignment

The Terms and Conditions between you and us are binding on you and us.

You may not assign or transfer these Terms and Conditions or any of your rights and/or benefits or obligations under these Terms and Conditions, without our prior written consent.

We may transfer, assign, charge, subcontract or otherwise dispose of these Terms and Conditions, or any of our rights or obligations arising under them, at any time provided we inform you and your rights under these Terms and Conditions are not prejudiced.

Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performing, any of our obligations under these Terms and Conditions that are caused by events outside our reasonable control (“Force Majeure Event”).

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • the closure or unavailability of one of your selected Causes;
  • strikes, lock-outs or other industrial action;
  • civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  • fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters;
  • impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
  • impossibility of the use of public or private telecommunications networks; and
  • acts, decrees, legislation, regulations, or restrictions of any government.

Our performance under these Terms and Conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under these Terms of Service may be performed despite the Force Majeure Event.

Entire agreement

These Terms and Conditions, together with the Share To Care terms if you create a Care Page, represent the entire agreement between us in relation to their subject matter and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

If your complaint is about a Cause, please contact the Cause directly.

Complaints about content on Legacy, or about a decision we made about your content or account, are handled as described under Complaints and appeals. Complaints about how we use your personal data are covered in our Privacy Policy.

Governing law and jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law.

Any dispute or claim arising out of or in connection with these Terms and Conditions, their subject matter or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the English courts. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. We retain the right to bring proceedings against you for breach of these Terms and Conditions in your country of residence or any other relevant country.
